TO: THE LEGISLATURE OF THE STATE OF CALIFORNIA IN THE MATTER OF ILLEGAL ACTS BY SCHOOL OFFICIALS IN THE STATE OF CALIFORNIA WHEREAS, school districts in the state of California have almost total autonomy; and WHEREAS, the California Education Code has inadequate enforcement provisions; and WHEREAS, as a result of the above conditions, school districts in the state of California deliberately, routinely and maliciously violate sections of the California Education Code and other laws; and WHEREAS, said violations have resulted in inequitable and illegal treatment of students and stakeholders, such as illegal suspensions and “opportunity transfers”, illegal grading procedures, false arrests of students, physical and mental child abuse and the cover-up and other obstruction of fact finding in these and other forms of intimidation and retaliation; and WHEREAS, the California Commission on Teacher Credentialing (CCTC) is required by law to investigate allegations of improper, unprofessional and/or illegal conduct and to take appropriate action; and WHEREAS, the CCTC reports directly to the Governor of the State of California; and WHEREAS, the office of State Superintendent of Schools is largely a ceremonial position with little jurisdiction over California school districts; and WHEREAS, the CCTC has willfully failed to fulfill its’ lawful obligations in the case of affidavits filed against 37 employees of the Los Angeles Unified School District (LAUSD) and others by refusing to respond appropriately to allegations of wrongdoing; and WHEREAS, certain elected officials in state government have willfully failed in their obligations to represent the interests of their constituents in the matters described and have, instead, acted in collusion with perpetrators to obstruct fact-finding with respect to the aforementioned allegations, BE IT RESOLVED, THEREFORE, that the undersigned citizens call on the legislature of the State of California to cause the following: 1. The removal of the autonomy of California school districts and the return of said districts to the jurisdiction of county offices of education which, in turn, will come under the jurisdiction of the State Superintendent of Schools in all matters; and 2. The enactment of legislation to grant responsibility and authority to the office of State Superintendent of Schools to enable said office to properly perform required functions; and 3. The enactment of legislation to provide for enforcement provisions in the California Education Code, including monetary fines and imprisonment for offenses; and 4. A legislative investigation into the failure of the CCTC to investigate and take appropriate actions respecting the allegations of wrongdoing against LAUSD and other California school districts; and 5. A legislative ethics investigation into any and all public officials alleged to share culpability in the failure of the CCTC to investigate and act appropriately respecting the aforesaid allegations; and 6. Appropriate remedial action, including criminal prosecution and termination of employment, of all government employees, including public officials, found to have committed improper, unprofessional and/or illegal acts, including the cover-up of wrongdoing or other obstruction of fact-finding.
